Hartford Off Hook For Malpractice Action Against NY Firm

Law360, New York (October 16, 2013, 2:10 PM EDT) -- Handelman Witkowicz & Levitsky LLP failed to properly notify its insurer of a possible malpractice claim over the dismissal of a personal injury action, a New York appellate court said Tuesday, affirming that a Hartford Financial Services Group Inc. unit didn't have to defend or indemnify the law firm.

The unanimous, four-judge opinion in New York City's First Department, a mid-level appellate court, upheld Manhattan trial Judge Lucy Billings' February ruling in favor of the Property & Casualty Insurance Co. of Hartford.
