6th Circ. Revives Ex-Cingular Worker's Race Bias Suit

Law360, New York (October 17, 2013, 8:20 PM EDT) -- The Sixth Circuit revived a black ex-employee's race discrimination suit against Cingular Wireless Employee Services LLC for laying him off during a workforce reduction despite his purportedly exceptional performance, ruling Thursday that he had provided sufficient evidence to keep his case in court.

A three-judge panel reversed a lower court's decision to grant Cingular summary judgment and nix the case brought by Anthony Rachells, who sued the company after being terminated as part of a workforce reduction following Cingular's 2004 acquisition of AT&T Wireless Services Inc....
