9th Circ. Reverses Enviros' Win On Greenhouse Gas Regs

Law360, Los Angeles (October 17, 2013, 4:38 PM EDT) -- The Ninth Circuit ruled Thursday that environmental groups looking to force Washington state regulators to impose tighter greenhouse gas emission regulations on oil refineries did not sufficiently argue that their injuries directly resulted from the regulators’ lack of enforcement.

The three-judge panel wrote that the groups lacked Article III standing to bring their claims to court: The groups and their individual members didn’t successfully prove that the failure of the government agencies to enforce existing emissions standards was the cause of the global warming problems described...
