2nd Circ. Revives Suit Against Lebanese Bank Over Attacks

Law360, New York (October 18, 2013, 4:15 PM EDT) -- The Second Circuit on Friday revived a suit alleging Lebanese Canadian Bank SAL enabled deadly rocket attacks in Israel by financing Hezbollah through an American Express Bank Ltd. account, saying U.S. jurisdiction exists to adjudicate the dispute.

After seeking guidance from the New York Court of Appeals concerning the scope of New York’s long-arm statute, a three-judge panel for the Second Circuit concluded that subjecting the foreign bank to personal jurisdiction in New York comports with due process protections provided by the U.S. Constitution.
