DC Circ. Junks Challenge To Navistar EPA Permits

Law360, Washington (October 18, 2013, 7:41 PM EDT) -- The D.C. Circuit on Friday rejected a bid by truck engine makers to invalidate environmental compliance certificates granted to Navistar Inc. by the U.S. Environmental Protection Agency in order to open up an enforcement action against Navistar, ruling the challenge was moot.

The petitioners' challenge to the disputed certificates of conformity — which allowed Navistar to exceed EPA nitrogen oxide, or NOx, standards in return for paying a per-engine penalty — had been based on an interim rule that had already been vacated, with the certificates...
