Fed. Circ. Upholds Mercedes Win In Tired Driver IP Case

Law360, New York (October 22, 2013, 6:23 PM EDT) -- The Federal Circuit on Tuesday affirmed a lower court's ruling invalidating a patent for a system to alert sleepy drivers, which Mercedes-Benz USA LLC was accused of infringing, ruling that the patent fails to explain how it detects drowsiness.

The appeals court upheld a district court's ruling last year that Ibormeith IP LLC's patent is invalid as indefinite. An algorithm included in the patent does not have terms that are "defined and understandable," the court wrote.
