Fla. Appeals Court Lifts Partial Injunction On Insurance Law

Law360, New York (October 24, 2013, 2:26 PM EDT) -- A Florida appeals court on Wednesday reversed a trial court’s order blocking part of a controversial state auto insurance law for a group of health care providers including an acupuncturist, a chiropractor and others, saying the law did not violate their constitutional rights.

The plaintiffs brought the suit against the Commissioner of the Florida Office of Insurance Regulation claiming that Florida’s 2012 Personal Injury Protection Act violates multiple provisions of the state constitution, including the right of access to courts.
