Cop's Facebook Rant Isn't Protected Speech, 11th Circ. Says

Law360, Washington (October 24, 2013, 5:08 PM EDT) -- The Eleventh Circuit recently affirmed the dismissal of an Atlanta police officer's claims that the city and its police chief violated her First Amendment rights by denying her a promotion while she was under investigation for criticizing the department on Facebook. 

A three-judge panel said in a nonprecedential opinion Oct. 17 that a lower court had properly dismissed Maria Gresham’s suit, finding the police department wasn’t required to show that the department was “disrupted” by her posts criticizing a colleague.
