Law360, New York (October 28, 2013, 6:43 PM EDT) -- The Eleventh Circuit on Monday ended an attempt by credit provider Atlanticus Holdings Corp. to bring antitrust counterclaims in a suit brought by 21 hedge funds seeking to collect a debt, ruling the issue had been sufficiently litigated in a parallel lawsuit.
In a unanimous opinion, the three-judge panel made clear that the antitrust claims Atlanticus was seeking were identical to its complaint in a separate lawsuit against the same group of hedge funds.
