Allergan Can't Beat Widower's Botox Poisoning Suit

Law360, New York (October 29, 2013, 9:15 PM EDT) -- An Illinois federal judge on Friday refused to dismiss a widower's wrongful death suit claiming his wife received Botox injections manufactured by Allergan Inc. to treat a jaw ailment and developed a brain disorder as a result, which allegedly led to her suicide.

U.S. District Judge Thomas M. Durkin trimmed some claims in the suit by Klaus Rosenstern, but allowed many of them to proceed — including claims for failure to warn, negligence and breach of express warranty — finding Rosenstern’s suit made specific enough claims...
