Wendy's, Ice Cream Maker Settle 'Frosty' Infringement Fight

Law360, New York (October 30, 2013, 1:23 PM EDT) -- A Cincinnati-based ice cream maker accused of ripping off Wendy's International Inc.'s "Frosty" trademark has agreed to stop using the name. 

United Dairy Farmers Inc., which allegedly sold imitations of Wendy's famous product in packaging that was confusingly similar to the iconic yellow and red trade dress of the world's third-largest fast food chain, will stop sales of its "Frosty Malts" or just cease using the mark by or before Nov. 30, according to a consent judgment signed by an Ohio federal judge Tuesday.
