Foley & Lardner May Add Defenses Over Patent Filing

Law360, New York (February 27, 2008, 12:00 AM EST) -- A California federal court has allowed Foley & Lardner LLP to add new defenses against a pharmaceutical development company that claims it lost international rights to drug delivery technology because the law firm filed a patent application late.

Chief Judge Irma E. Gonzalez of the of the U.S. District Court for the Southern District of California ruled on Wednesday that Foley & Lardner may add an affirmative defense that Vaxiion Therapeutics Inc.'s patent applications were not impacted by the law firm's dual representation of the company...
