6th Circ. Says No Soul To R&B Singer's 'Soul Men' Suit

Law360, Washington (October 31, 2013, 5:42 PM EDT) -- The Sixth Circuit on Thursday refused to resurrect R&B singer Sam Moore's trademark suit against Metro-Goldwyn-Mayer Studios Inc., The Weinstein Co. and others for allegedly misappropriating his image and unregistered trademarks in the 2008 comedy film “Soul Men,” saying there wasn't enough evidence to bolster his claims.

Although Moore claimed the film infringed on his unregistered trademarks for various versions of the “Soul Men” title and appropriated his life for the story, the appellate court said the movie took enough creative liberty to skirt the allegations...
