Nestle Hit With Trademark Suit Over Purina 'Instinct' Line

Law360, New York (November 1, 2013, 2:24 PM EDT) -- Nestle Purina PetCare Co. landed in the trademark doghouse Wednesday, accused by a smaller pet food company of infringing registered trademarks by launching a line of dog food under the name “True Instinct.”

Nature’s Variety Inc., a privately held company based in St. Louis, says it's used the name “Instinct” for one of its two lines of all-natural pet food since 2006. It says Purina's new line — launched earlier this year — threatens to engulf the pre-existing brand.
