6th Circ. Backs Chesapeake In Ohio Gas Lease Fight

Law360, New York (November 1, 2013, 3:40 PM EDT) -- The Sixth Circuit on Wednesday sided with Chesapeake Exploration LLC in a dispute with Ohio landowners, saying a lower court correctly determined that landowners have no right to terminate Chesapeake's oil and gas leases if the company refuses to match third-party offers to lease the land.

The leases at issue gave Chesapeake the right to match any third-party offer to lease the land for oil and gas exploration. The landowners argued that if Chesapeake declines to match the offer, they could terminate the company's lease in order to enter an immediate new lease with the third-party.
