An Attempt To Clarify Race-Based Admissions Policies

Law360, New York (November 6, 2013, 2:59 PM EST) -- Following the June 24, 2013, decision by the United States Supreme Court in Fisher v. University of Texas at Austin, institutions of higher education were still left with questions on the use of race as a factor in admissions. Far from being the clarifying decision that many had hoped for, the Supreme Court remanded the Fisher case with instructions to the lower court to review the university's actions under the strict scrutiny standard.
