Federal Circuit Issues Mixed Ruling In Dako Case

Law360, New York (February 28, 2008, 12:00 AM EST) -- A federal appeals court panel issued a mixed ruling Thursday in a patent infringement suit that the University of California and Abbott filed against Danish cancer diagnostics firm Dako A/S, finding that the lower court correctly construed some, but not all, claims in the case.

The U.S. Court of Appeals for the Federal Circuit affirmed the lower court's denial of the plaintiff's request for preliminary injunction and affirmed part and reversed part of the court's decision to grant partial summary judgment to the defendant.
