Shopko Escapes FCA Suit Claiming Medicaid Overcharges

Law360, Los Angeles (November 7, 2013, 7:05 PM EST) -- A Wisconsin federal judge dismissed a False Claims Act suit brought by an ex-employee of a retail pharmacy chain, ruling Tuesday that he didn't show the company's alleged overcharges to Medicaid were knowingly false.

Carl Thulin, a pharmacist for Shopko Stores Operating Co. LLC, claimed that for patients with both private insurance and Medicaid, Shopko would initially send a claim for medication to the private insurer, who was bound to pay first.
