New NLRB Counsel Calls 'Micro-Unit' A Misnomer

Law360, New York (November 8, 2013, 8:03 PM EST) -- Defending the National Labor Relations Board's controversial Specialty Healthcare decision, the board's newly sworn-in general counsel Richard F. Griffin Jr. said Friday that critics' concerns about the proliferation of small bargaining units called "micro-units" mislabeled the issue.

In the Specialty Healthcare decision, the board heightened the standard for employers challenging narrow collective bargaining units, and critics of the decision — including management side attorneys, business groups and Republican lawmakers — have argued that the decision would lead “micro-units” to spring up.
