Judge Tosses Suit Against Anthrax Vaccine Policy

Law360, New York (March 3, 2008, 12:00 AM EST) -- A federal judge has dismissed a class action by a group of U.S. military personnel challenging the Pentagon's mandatory anthrax vaccine program.

Judge Rosemary M. Collyer of the U.S. District Court for the District of Columbia dismissed the complaint Friday, saying the U.S. Food and Drug Administration, which approved the vaccine, had properly relied on clinical trials of an earlier vaccine and had acted neither arbitrarily nor capriciously.
