Fla. Judge Tosses Suit Over Gray-Market Slot Ban

Law360, Los Angeles (November 13, 2013, 9:10 PM EST) -- A Florida federal judge on Wednesday dismissed an Internet cafe's challenge to a state law banning gray-market slot machines, finding the plaintiff failed to allege a constitutional injury to its business.

U.S. District Judge Ursula Ungaro dismissed Incredible Investments LLC's complaint, saying the company didn't support its assertion that the slot machine ban is unconstitutional and unfairly impacts legitimate businesses. Incredible Investments operates an Internet cafe in Homestead, Fla, that used sweepstakes to advertise its business.
