NJ High Court To Mull Statute Of Limitations On Spill Suits

Law360, New York (November 15, 2013, 5:29 PM EST) -- The Supreme Court of New Jersey on Thursday agreed to consider whether actions brought under the state’s Spill Compensation and Control Act are barred by a general statute of limitations, even though the Spill Act itself contains no such provision.

New Jersey’s high court granted certification to Morristown Associates, a shopping center owner that sued Spartan Oil Co. and several other oil companies for remediation costs born of an underground well that leached heating oil into the property’s soil and groundwater.
