Hanes Looks To Squash Lululemon Tank Top Patent

By Alex Lawson (November 18, 2013, 11:47 AM EST) -- Hanesbrands Inc. on Friday asked a North Carolina federal court to declare that a line of its athletic tank tops sold at Target Corp. stores does not violate a design patent held by Lululemon Athletica Canada Inc. and that the patent is invalidated by prior art.

HBI filed the declaratory judgment suit after receiving a cease-and-desist letter from Lululemon on Oct. 30 stating that various lines of HBI tank tops are flouting U.S. Design Patent Number D654,665S, which covers the design for a tank top with a brassiere attached to the inside of the shirt.
