Microsoft Asks 2nd Circ. To Kill Licensing Antitrust Suit

Law360, New York (November 18, 2013, 7:14 PM EST) -- Microsoft Corp. on Monday asked the Second Circuit to toss an appeal aimed at resurrecting a computer-sharing software company’s antitrust suit over its Windows licensing rules, saying it has the freedom to license software as it chooses.

Antitrust law does not require the computer giant to preserve a loophole in its end-user licenses that company Miniframe Ltd. relied on, a lawyer for Microsoft said at oral arguments before a panel of judges in Manhattan.
