Tampa Bay Drops Cracked-Reservoir Suit In 11th Circ.

Law360, New York (November 19, 2013, 8:28 PM EST) -- The 11th Circuit on Friday granted Tampa Bay Water’s unopposed motion to voluntarily dismiss its case against HDR Engineering Inc., in which the agency sought millions of dollars in damages over abnormal cracking in a drinking water reservoir.

Tampa Bay Water’s board of directors voted 8-0 last month to pay a total of $21 million for HDR’s legal fees and costs, to end the litigation against it over the damaged C.W. Bill Young Regional Reservoir. The board then asked the appeals court to dismiss its attorneys' fees...
