Fla. Appeals Court Affirms $4M Fee Award In Tree Taking Suit

Law360, Miami (November 20, 2013, 5:59 PM EST) -- A Florida appeals court on Wednesday awarded nearly $4.25 million in attorneys' fees in a class action over the Florida Department of Agriculture's removal of thousands of residential citrus trees, rejecting the department's arguments that the amount was unreasonable and did not comply with state law.

The state had claimed that the trial court abused its discretion in calculating the award, which represented 98 percent of the judgment minus interest and a $538 per-hour average rate, the highest ever for a Florida eminent domain case....
