6th Circ. Sides With Liberty In Contractor Coverage Row

Law360, Chicago (November 20, 2013, 6:27 PM EST) -- The Sixth Circuit on Tuesday bailed out Liberty Mutual Fire Insurance Co. from covering  two contractors for their shoddy work building a Kentucky Wal-Mart, finding that the store’s defective foundation and resulting structural damage did not constitute an “occurrence” under the policy.

In a short opinion, the three-judge panel reversed a lower court’s decision in favor of the contractors, Kay & Kay Contracting LLC and MW Builders Inc., and ordered that summary judgment be entered in favor of the insurance company.
