Army Corps Appeals Ruling Halting Charleston Dock Project

Law360, New York (November 20, 2013, 5:52 PM EST) -- The U.S. Army Corps of Engineers is appealing a South Carolina federal judge’s decision tossing out a permit for the agency’s planned $35 million cruise ship terminal in Charleston, S.C., to the Fourth Circuit, according to court documents filed Monday.

U.S. District Judge Richard Gergel ruled in September that the corps improperly characterized work on the terminal project as maintenance that did not require a full pre-approval environmental analysis, granting summary judgment in favor of two state groups focused on historic preservation and environmental conservation....
