Discovery Order In GEICO Split-Claims Row Gets Reversed

Law360, New York (November 21, 2013, 5:55 PM EST) -- A New Jersey appeals court ruled Thursday that a lower court improperly allowed simultaneous discovery on underinsured motorist and bad faith claims, which were bifurcated for trial in a coverage suit against Government Employees Insurance Co., saying it prejudiced GEICO and wasted court resources.

A three-judge panel of the New Jersey Superior Court Appellate Division agreed with GEICO that the lower court had abused its discretion by compelling discovery on plaintiff James Procopio Jr.’s bad faith claims to proceed before resolution of his underinsured motorist claim,...
