Texas Justices Take On $125M Tenaska Arbitration Dispute

Law360, New York (November 22, 2013, 4:39 PM EST) -- The Supreme Court of Texas has agreed to hear a dispute between Ponderosa Pine Energy LLC and Tenaska Energy Inc. arising from a trial court’s decision to vacate Ponderosa's $125 million arbitration award over the sale of a Texas power plant, which an appeals court later reinstated.

Last August, Texas' Fifth Court of Appeals held that a trial judge wrongly vacated the award because arbitrator Samuel A. Stern had properly disclosed his relationships with Nixon Peabody LLP attorneys who represented Ponderosa, and because Tenaska Energy Inc.,...
