Eli Lilly Loses Case Brought By Tiny Biotech Company

Law360 (January 9, 2006, 12:00 AM EST) -- Rejecting claims of a contract breach, an Indiana federal judge has ruled against Eli Lilly & Co. in a lawsuit that accused the pharmaceutical giant of stealing technology originally licensed to it by a small biotech company.

U.S. District Court Judge David F. Hamilton denied Lilly’s claim that New York-based Emisphere Technologies broke their agreement in 2004, marking the latest development in a two-year battle waged over technology used to convert injectable-only drugs into ones that can be taken orally.
