Ford Fights High Court Appeal On CERCLA Subrogation

Law360, New York (December 3, 2013, 4:55 PM EST) -- Ford Motor Co. urged the U.S. Supreme Court to not take up an insurer’s request to decide whether the Comprehensive Environmental Response, Compensation and Liability Act allows subrogation recovery for environmental cleanup expenses, saying Monday that there is no circuit conflict.

The automaker says Chubb Custom Insurance Co. has not presented any compelling reason why the high court should review a Ninth Circuit ruling that in March found the insurer could not recoup $2.4 million from Ford and others over cleanup expenses at a polluted patch...
