Water Conservation Group Can't Ax Texas Town's Permit

Law360, Dallas (December 4, 2013, 7:03 PM EST) -- A Texas appeals court upheld the city of San Angelo’s municipal water permit, rejecting on Tuesday a conservation group's argument that the Texas Commission on Environmental Quality had ignored evidence the permit would negatively impact downstream water users.

The Seventh District Court of Appeals found that the TCEQ properly granted a permit amendment to San Angelo Water Supply Corp. after evidence showed the amendment didn’t increase authorized water appropriations and wouldn’t harm any water rights downstream from its reservoir.
