9th Circ. Rules Fee Award Against UPS Is Fair

Law360, Washington (December 5, 2013, 5:48 PM EST) -- The Ninth Circuit on Thursday upheld the award of nearly $700,000 in attorneys’ fees to a former United Parcel Service Inc. employee in her discrimination case against the company, ruling California law allowed for the disparity between the fee award and her $27,000 damages award.

In a 2-1 published decision, the appellate court panel ruled that U.S. District Judge Claudia Wilken had not — with the exception of certain paralegal fees based on hearsay evidence — abused her discretion when she awarded Kim Muniz attorneys’ fees...
