P&G Can't Bar Testimony In Fixodent Suit, 11th Circ. Hears

Law360, Miami (December 11, 2013, 7:30 PM EST) -- A plaintiff in multidistrict litigation over Procter & Gamble Manufacturing Co. dental cream told the 11th Circuit on Wednesday that a lower court had erred in excluding expert testimony linking the cream to her neurological damage.

Derek T. Ho of Kellogg Huber Hansen Todd Evans & Figel PLLC, who represents plaintiff Marianne Chapman, told the appeals panel that the testimony from epidemiology, toxicology and neurology specialists was information used in the field and taught in medical school, and was therefore blocked improperly.
