Ariz. Wants High Court Review of Medicaid Abortion Law

Law360, New York (December 10, 2013, 2:43 PM EST) -- Arizona officials have asked the U.S. Supreme Court to back its position that states may determine who qualifies as a Medicaid provider and revive a law denying funding to providers who perform elective abortions, according to a petition made available Monday.

Lawyers for the state say the Ninth Circuit's August ruling that the 2012 law at issue violates the Medicaid Act's free-choice-of-provider requirement erred by disregarding what they say is a decisive ambiguity in the statutory text concerning how to define a “qualified” provider, according to...
