PetSmart Workers Win Conditional Class Cert. For OT Suit

Law360, New York (December 11, 2013, 7:07 PM EST) -- A Delaware federal judge on Monday conditionally certified a class of PetSmart Inc. operations managers to bring a collective action claiming that the retail chain misclassified them as exempt from the Fair Labor Standards Act's overtime requirements.

U.S. District Judge Sue L. Robinson signed off on the plaintiffs' bid for conditional certification, finding that they had met the burden for conditional certification by showing that there was a factual nexus between their own experiences on the job and that of other operations managers throughout the country....
