GM Escapes Suit Over $450M In Retiree Medical Benefits

Law360, Los Angeles (December 10, 2013, 8:11 PM EST) -- A Michigan federal judge on Tuesday tossed a breach of contract suit accusing General Motors LLC of skirting $450 million in owed retiree medical benefits, ruling that the company wasn't obligated to pay the benefits after it went through bankruptcy restructuring.

Granting GM's motion for summary judgment, U.S. District Judge Avern Cohn said a deal over medical benefits that the parties struck in 2009 didn't mention the previously owed $450 million amount, thus there was no factual dispute as to whether the newly restructured company assumed...
