DC Circ. Vacates EPA Rule On Heavy-Truck Air Standards

Law360, New York (December 11, 2013, 7:54 PM EST) -- The D.C. Circuit on Wednesday threw out the U.S. Environmental Protection Agency's final rule for determining which heavy truck manufacturers comply with new air standards, handing a win to Daimler AG and other companies that challenged the rule.

The appeals court found that the EPA hadn't given sufficient notice or a comment period in establishing its criteria for determining access to the marketplace.
