Law360, New York (December 13, 2013, 7:38 PM EST) -- A California federal judge on Monday rejected Best Buy Stores LP’s request to dismiss a suit brought by two of the store’s assistant managers who claim they are owed lost overtime pay, saying it is disputed whether the plaintiffs performed mostly overtime-exempt duties.
U.S. District Judge Andrew J. Guilford refused to dismiss former Best Buy employees Kurt Swanson and Tawny Perez’s suit, saying that it is possible that a majority of the employees’ work qualified for overtime.
