3rd Circ. Asked To Tackle Venue Dispute In Paxil Suit

Law360, New York (December 13, 2013, 7:30 PM EST) -- A Pennsylvania federal judge overseeing a Paxil birth defect lawsuit against GlaxoSmithKline PLC asked the Third Circuit on Thursday to determine for the second time whether defendants can send a case from state to federal court more than a year after the suit began.

The question has divided Pennsylvania federal courts handling the Paxil litigation since a landmark Third Circuit ruling in June in a suit against GSK over the morning-sickness drug thalidomide, according to U.S. District Judge Christopher Conner.
