JC Penney, Texas Co. Drop Patent Suit Over Bar Code Ads

Law360, New York (December 13, 2013, 6:20 PM EST) -- A Texas company dropped its suit against J.C. Penney Corp. Inc. accusing the retail giant of infringing its patented bar code technology that allows customers to procure product information through print advertisements with their cellphones, according to a joint motion filed Friday in Texas federal court.

The joint motion for dismissal now awaits the signature of U.S. District Judge Leonard Davis. The motion would also vacate the declaratory judgment counterclaims filed by J.C. Penney earlier this year.
