Jury Hits BNSF With $10M Verdict In Fatal Crossing Crash Suit

Law360, New York (December 17, 2013, 6:29 PM EST) -- An Oklahoma state court jury on Monday hit Burlington Northern Santa Fe Railway Co. with an $9.6 million judgment over the death of a man who was struck by a train while crossing tracks in his vehicle.

The jury found BNSF to be 65 percent liable for the fatal crash, and apportioned 35 percent responsibility to the victim, Jeffery Nye, his lawyer said Tuesday. The total damages were set at $14.8 million. Nye was killed when a BNSF train struck his Jeep on Dec. 29, 2008....
