Energy Co. Trustee Sues NY Over Fracking Moratorium

Law360, New York (December 18, 2013, 3:05 PM EST) -- The bankruptcy trustee of an energy company that went belly-up while waiting for New York to lift its hydraulic fracturing moratorium lodged a suit against the state on Tuesday, demanding that officials finalize an environmental and health review of fracking that has lasted more than five years.

Norse Energy Corp. trustee Mark S. Wallach claims the state has fallen far short of its obligation to complete the supplemental generic environmental impact statement for high-volume hydraulic fracturing promptly and with “minimal procedural and administrative delays.”
