National Fire Ducks Coverage Of Construction Defect Suit

Law360, New York (December 20, 2013, 2:41 PM EST) -- An Arizona federal judge on Thursday tossed Steadfast Insurance Co.'s lawsuit seeking National Fire & Marine Insurance Co.'s help providing coverage for the settlement of litigation surrounding alleged construction defects in a residential community, finding it is time-barred.

National Fire argued that Steadfast's contribution and indemnification claims are barred by a three-year statute of limitations for an action involving a debt “not evidenced by a contract in writing,” which National Fire said applies to Steadfast's claims.
