Texas City Asks High Court To End Power Contract Suit

Law360, Dallas (January 3, 2014, 4:06 PM EST) -- A Texas city on Monday asked the Texas Supreme Court to find it’s immune from a breach of contract suit brought by the Lower Colorado River Authority over the city’s cancellation of its wholesale power agreement, arguing the case threatens public financing stability.

After an appeals court in August gave the LCRA the go-ahead to pursue claims against the city of Georgetown, and later denied Georgetown’s motions for rehearing and en banc reconsideration, the city is arguing that immunity from the contract suit is required under...
