FDA Leaves Food Cos. In Lurch When Fighting Labeling Suits

Law360, New York (January 8, 2014, 8:33 PM EST) -- Food companies are likely to face more class actions, on less favorable grounds, as a result of the U.S. Food and Drug Administration's Monday refusal to sanctify the industry's preemption defense and declare that genetically modified food can be labeled “natural.”

In a letter to three federal judges, the FDA said it would not determine at that time whether companies can use the terms “natural” and “all natural” to describe food that contains genetically modified ingredients. The judges, who requested the FDA's input on the matter,...
