Punitive Damages Still Closed To Ex-Jacoby & Meyers Atty

Law360, New York (January 9, 2014, 6:59 PM EST) -- A New York state judge declined Tuesday to reconsider her decision that a former Jacoby & Meyers LLP attorney can't pursue punitive damages against his ex-law firm over allegations they falsely told clients that he filed for bankruptcy, saying the lawyer is rehashing old arguments.

Judge Barbara Jaffe said that former Jacoby & Meyers attorney Michael Flomenhaft is merely restating his contention that the judge misapplied the controlling law on punitive damages and his claim that she overlooked another decision he purports to be the law...
