Eni's Natural Gas Duties Clear In Contract, NJ Court Says

Law360, New York (January 10, 2014, 9:18 PM EST) -- A New Jersey appellate panel on Thursday affirmed a $661,000 judgment against Eni Petroleum US LLC, siding with Hess Corp. over the force majeure provisions of a natural gas contract on which Eni failed to perform due apparently to unforeseeable supply issues.

A three-judge panel on the Superior Court of New Jersey’s Appellate Division upheld the judgment for Hess, ruling Eni’s contract with Hess, forged in September 2007, was clear and unambiguous in its requirements for Eni to deliver 20,000 dekatherms of natural gas per day....
