Bad Rulings Foiled $400M Patent Suit, ISE Tells Fed. Circ.

Law360, Washington (January 9, 2014, 3:49 PM EST) -- International Securities Exchange LLC asked a Federal Circuit panel Thursday to wade into its $400 million trading system patent battle with Chicago Board Options Exchange Inc., claiming an Illinois federal judge improperly undermined their case with a series of evidence-limiting decisions.

Although ISE's case was set to go to trial in March, the company told the Federal Circuit during Thursday's oral arguments that U.S. District Judge Joan Lefkow's pretrial rulings in CBOE's favor prevented ISE from moving forward with the proceedings.
